These Terms and Conditions ("Terms") govern your purchase and use of digital products, templates, courses, calls, and coaching offered by Maggie Messer Photography ("we," "us," or "our").
By purchasing or accessing any of these products or services, you agree to these Terms. If you do not agree, please do not complete your purchase.
These Terms apply to our digital and educational offerings, including but not limited to the Sell Without Selling ebook (The IPS Shortcut), the Artist Recommendation Canva template, the Jumpstart Call, and the Sell Without Selling Accelerator.
Portrait and photography session bookings are governed by our separate photography service agreement.
1. Products and Services
We offer digital downloads, templates, live and recorded educational content, one-on-one calls, and coaching programs. Descriptions of each product are provided at the point of purchase. We reserve the right to update, improve, or discontinue any product at any time.
2. Pricing and Payment
All prices are listed in U.S. dollars and are due in full at the time of purchase. Payment is processed securely through our checkout provider. You are responsible for reviewing all items and the total shown before completing your purchase. Prices and promotions may change at any time, but changes do not affect purchases already completed.
3. All Sales Are Final
Due to the digital nature of these products, all sales are final. No refunds or credits will be issued under any circumstances, even if the product is not accessed or a coupon code is not applied. By completing your purchase, you confirm that you have reviewed all items and total pricing and agree to this policy.
4. License and Permitted Use
When you purchase a digital product or template, you receive a single-user, non-transferable license to use it in your own business.
You may:
Use the ebook and its methods in your own photography business.
Use the Artist Recommendation Canva template to create recommendations for your own clients.
You may not:
Resell, sublicense, share, distribute, or give away the ebook, template, or any purchased materials.
Share your account, download links, or template access with anyone else.
Reproduce, repackage, or republish the content as your own product, course, or template.
Use the materials to create a competing product for resale.
Your license may be revoked if these Terms are violated.
5. Intellectual Property
All content, including the ebooks, templates, frameworks, methods, names (such as the Artist Recommendation), text, graphics, and course materials, is the intellectual property of Maggie Messer Photography and is protected by copyright and other laws. Your purchase grants you a license to use the materials as described above. It does not transfer ownership.
6. No Guarantee of Results
Our products and services are educational. They share methods, tools, and ideas, but your results depend on many factors we do not control, including your own effort, your market, your pricing, and your clients.
We make no promise or guarantee of any specific income, sales, or business result. Any examples, figures, or stories are for illustration only and are not a promise of what you will earn.
7. Calls and Coaching
For the Jumpstart Call, the Accelerator, and any other live session:
Sessions are scheduled by mutual agreement after purchase.
If you need to reschedule, please give at least 24 hours notice. Sessions missed without notice, or cancelled with less than 24 hours notice, may be forfeited.
Any unused calls or coaching sessions expire and are forfeited one year after the date of purchase.
Coaching and calls provide guidance and recommendations. You remain responsible for the decisions you make in your own business.
8. Limitation of Liability
To the fullest extent permitted by law, Maggie Messer Photography is not liable for any indirect, incidental, or consequential damages arising from your use of our products or services. Our total liability for any claim is limited to the amount you paid for the product or service giving rise to the claim.
9. Testimonials
Any testimonials or client stories shared reflect individual experiences and are not a guarantee that you will achieve the same or similar results.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute will be handled in the appropriate courts located in Texas.
11. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time of your purchase applies to that purchase. Continued use of our products after an update means you accept the revised Terms.
